Back wheels are not aligned and the center pivot won't stay down.

We opened up the wagon. It is bigger than expected. When we set it up the first thing my husband saw is the 2 rear wheels are not aligned. This causes the wagon to want to run sideways. The center pivot in the bottom of the wagon does not lock down. Wanted to return for exchange, but they are out of stock. Directions in the box were poorly written.
